The General Data Protection Regulation (GDPR) is Europe’s data protection law, adopted by the EU in 2016. It dictates how businesses use EU customers’ data, including how they store, move, and secure data. The law follows seven key principles: lawfulness, fairness, and transparency; purpose limitation; data minimization; accuracy; storage limitation; integrity and confidentiality; and accountability. Those breaching GDPR laws are subject to hefty penalties and fines.
Personal Information Protection Electronic Documents Act (PIPEDA) refers to Canada’s privacy law. It covers how private businesses collect, use, and convey customer information. PIPEDA has extensive overlaps with EU regulation, including the need for customers’ consent and data breach notifications, amongst many other aspects.
While the US doesn’t have a central law regulating data, different states have created their own laws following the implementation of GDPR. So far, only two states have successfully passed their own laws: California with its California Consumer Privacy Act (CCPA), and Virginia with its Consumer Data Protection Act (CDPA). More states are currently in the process of actualizing their own data privacy laws, with Washington, Oklahoma, and New Hampshire close to putting their laws into effect.
